Blog of The Legal Times reports that this morning five Supreme Court justices were in attendance at the 55th annual Red Mass in Washington, sponsored by the John Carroll Society. Four of the 5 sitting Catholic Justices (Roberts, Scalia, Kennedy and Thomas), as well as Justice Breyer, who is Jewish, were there. Many lower court judges, ambassadors, at least one Cabinet member, law school deans and lawyers were also in attendance. The Red Mass is held each year on the Sunday before the opening of the U.S. Supreme Court's fall term, and is meant to bestow the Church's blessing on judges and civic leaders.

Justices who attend The Red Mass disgrace the Establishment Clause of the First Amendment. It is not surprising, for example, that Justices Scalia, Kennedy, Thomas and Breyer sided with the Texas's display of a Ten Commandments monolith donated by the Fraternal Order of Eagles on its capitol grounds, Chief Justice Roberts, who also attended, was not on the Court when it handed down its decision in Van Orden v. Perry in 2005.
We will never realize true religious freedom until we are free of government sponsored religion.
The John Carroll Society, which sponsors this event, is not part of the government, so I don't see a conflict with the Exclusion Clause.
Individuals should be free to practise their own religion as they see fit so long as they do not adversely impact anyone else. You cannot remove a man from his religious practise just because he has a particular profession. And so long as he is not breaking any laws, you can't impinge on his freedom of association, either.
Also, it looks to me that attendance is voluntary as well as inclusive. So, what's the problem, really?
